In small and mid-sized Chapter 11 and Subchapter V cases, the financial work often falls on company staff who have never prepared a cash collateral budget, a monthly operating report or plan projections. We work alongside debtor's counsel to produce that work quickly and to the standard the court, the U.S. Trustee or Subchapter V trustee, and creditors expect, so counsel can focus on the legal strategy.
What we provide in a case
First days: a 13-week cash flow budget to support cash collateral or DIP financing motions, and the financial information for first-day declarations.
Accounting set-up for Chapter 11: leadership in preparing the accounting system for the case, including the separation of pre-petition and post-petition transactions, accounts and liabilities.
Reporting: monthly operating reports and other financial reporting the court and the trustee require, prepared with the company's staff.
Cash management: day-to-day cash control under the approved budget; variance reporting.
The plan: strategizing with company management on the overall recovery plan; financial projections, feasibility and liquidation analyses, and the numbers behind negotiations with creditors; in Subchapter V, work paced to the 90-day plan deadline.
Leadership roles: chief restructuring officer, interim CFO or financial advisor to the debtor.
After confirmation: monitoring plan payments and rebuilding the finance function.
How we work with counsel
A senior partner leads every engagement and is the single point of contact for counsel.
We can start within days; the first priority is always the cash budget.
Retention is structured with counsel and submitted for court approval; we run a conflicts check before any engagement.
Scope and fees are sized to the case, including small Subchapter V cases.
We provide financial and operational leadership, not legal advice.
Our background
Partner-level experience at Booz Allen & Hamilton, Roland Berger and Adventis; more than $125 billion of telecom and media M&A in our team's earlier careers; and experience in both standard Chapter 11 and Subchapter V, including the financial restructuring of a multi-entity hospitality portfolio through Chapter 11.
Questions counsel ask
Can you prepare the 13-week budget before the first-day hearing?
Yes, when we are brought in early; the budget is always our first deliverable.
Do you work in Subchapter V cases with limited budgets?
Yes; we size the scope to the case.
Will you work with the company's existing bookkeeper or controller?
Yes. We build the reports with them and leave them able to maintain them.
How are you retained?
With counsel, through a court-approved application; we confirm disinterestedness first.
